Some studies have found that nearly 30% of American teens shared a nude photo of themselves with another teen. “I would bet my mortgage it’s happening in every city,” said psychologist Jeff Temple, an associate professor at the University of Texas.
Authorities in Canon City, Colo., said they are investigating the possibility that hundreds of high-school students were involved in sexting. The case has rocked the community, prompting school officials to cancel the football team’s final game after the athletic director and coach couldn’t guarantee no players were involved.
District Attorney Tom LeDoux said that under state law it doesn’t matter whether a student took and shared explicit photos voluntarily it is illegal, but he would use his discretion, looking at factors such as whether students were coerced.
Cases such as the one in Colorado underscore that many laws were written before the advent of smartphones, said University of Miami law professor Mary Anne Franks.
Coercion and unauthorized image-sharing should be punished, however a teenager shouldn’t be prosecuted for willingly exchanging nude images with another teen.
