AN IMMIGRATION JUDGE denied bail to City Council data analyst Rafael Andres Rubio Bohorquez on Feb. 2 after a brief hearing at the Varick Street immigration court, keeping him in ICE custody at Orange County Jail upstate following his Jan. 12 arrest at an asylum interview in Bethpage, Long Island, according to THE CITY.

Federal attorneys pointed to a 2023 roommate dispute that resulted in sealed charges and alleged Bohorquez misstated his arrest history in immigration filings, while his lawyer, Roger Asmar, argued the omission was tied to the sealing and said video undercuts the assault claim. “He’s failed to demonstrate he’s not a danger,” the judge at his hearing said.
U.S. Immigration and Customs Enforcement said Rafael Andres Rubio Bohorquez had long overstayed a tourist visa, had once been arrested for assault, and “had no legal right to be in the United States.”
New York City Mayor Zohran Mamdani, a Democrat, said he was “outraged” by what he called “an assault on our democracy, on our city, and our values.”
